1. Agreement to Terms

By accessing or using sethserver.com (the "Site"), operated by Fiscus Technology, LLC ("Company," "we," "us," or "our"), a Texas limited liability company, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site.

2. Description of Services

The Site provides the following services:

• Content & Blog — Articles, how-to guides, and educational content on software engineering, AI, Python, databases, and related topics.
• Consulting Services — Intake forms and proposals for software engineering consulting, fractional CTO services, and AI coding rescue engagements.
• Assessments & Tools — Free diagnostic assessments, an SEO analyzer, and other developer tools.
• AI Advisor — An AI-powered chat advisor that provides guidance based on published content. The advisor may require an email address and, beyond free-tier usage, a paid subscription via Stripe.
• Secret Sharing — An encrypted secret sharing tool for securely transmitting sensitive information.
• Software Licensing — A license validation API for software products sold through the Site.
• Newsletter — Email subscription for articles and updates.
• Books & Digital Products — Digital books and educational materials available for purchase through Stripe and LemonSqueezy.

3. AI-Generated Content Disclosure

We use artificial intelligence tools in the creation and maintenance of content on this Site. Specifically:

• AI is used to generate images for blog posts.
• AI is used for editing, update suggestions, internal link suggestions, and SEO optimization.
• The AI Advisor feature generates responses using large language models based on our published content.

While we make reasonable efforts to ensure accuracy, AI-generated content may contain errors or inaccuracies. All content on the Site is provided for informational purposes only and should not be considered professional advice. You should independently verify any information before relying on it for critical decisions.

4. User Accounts

Certain features of the Site may require you to provide personal information such as an email address. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.

5. Payments & Subscriptions

Paid services, including the AI Advisor subscription, books, and digital products, are processed through third-party payment processors (Stripe and LemonSqueezy). By making a purchase, you agree to the applicable payment processor's terms of service in addition to these Terms.

• Subscriptions — Recurring subscriptions will automatically renew until canceled. You may cancel at any time through your account or by contacting us.
• Refunds — Refund requests are handled on a case-by-case basis. Contact us at sblack@sethserver.com to request a refund.
• Digital Products — Due to the nature of digital products, all sales of downloadable content are final unless the product is materially defective.

6. Intellectual Property

All content on the Site, including but not limited to text, images, graphics, code examples, logos, and design elements, is the property of Fiscus Technology, LLC or its licensors and is protected by United States copyright, trademark, and other intellectual property laws.

Code examples published in blog posts are provided for educational purposes and may be used in your own projects. All other content may not be reproduced, distributed, or transmitted without prior written permission.

7. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to any portion of the Site, other accounts, or any systems or networks connected to the Site.
• Use automated tools (bots, scrapers, crawlers) to access the Site in a manner that exceeds reasonable use or circumvents rate limits.
• Interfere with or disrupt the integrity or performance of the Site or its services.
• Transmit any malicious code, viruses, or harmful data through any Site features including the secret sharing tool or contact forms.
• Abuse the AI Advisor by attempting prompt injection, jailbreaking, or using it to generate harmful, misleading, or unlawful content.

8. Secret Sharing Tool

The encrypted secret sharing tool is provided as a convenience for securely transmitting sensitive information. Secrets are encrypted and automatically expire. We do not have access to the content of encrypted secrets. You use this tool at your own risk, and we make no guarantees regarding the security or availability of shared secrets.

9. License Manager API

The software license validation API tracks installations and validates licenses for products sold through the Site. Usage of this API is subject to the specific license terms of each software product. Tampering with, reverse-engineering, or circumventing the license validation system is prohibited.

10. SMS Communications

If you opt in to receive SMS communications, you consent to receiving text messages from us at the phone number you provide. Message and data rates may apply. You may opt out at any time by replying STOP. See our Privacy Policy for details on how we handle your phone number.

11. Third-Party Links & Services

The Site may contain links to third-party websites and services. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your use of third-party services is governed by their respective terms.

12. Disclaimer of Warranties

THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

CONTENT ON THE SITE, INCLUDING AI-GENERATED CONTENT AND AI ADVISOR RESPONSES, IS FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE PROFESSIONAL, LEGAL, FINANCIAL, OR TECHNICAL ADVICE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FISCUS TECHNOLOGY, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE.

14. Indemnification

You agree to indemnify and hold harmless Fiscus Technology, LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Site or violation of these Terms.
