1.1 Definitions

1.1.1 For the purposes of these Terms of Service, 2dengine LLC is a Limited Liability Company (hereinafter referred to as "2dengine", "us" or "we"). 2dengine LLC is registered with the Delaware Secretary of State in the United States.

1.1.2 The End-User (hereinafter referred to as "you" or "User") is a natural person using the 2dengine software products or services through an electronic device.

2. What Kind of Data We Collect

2.1 Data Collection

2.1.1 2dengine collects information both automatically and when provided voluntarily by users in the course of engaging with our website or our software products.

2.2 Voluntarily Provided Data

2.2.1 Upon registering for an account, you must specify your country of residence and age. Your profile may be customized by entering a nickname and uploading an avatar picture. Your e-mail address is collected when you try to contact us and can optionally be associated with your profile.

2.2.2 Your billing and payment information is collected if you decide to purchase any of our premium software products.

2.2.3 Certain Users have the opportunity to participate in online chat conversations, write reviews, submit translations and other types of User-Generated Content.

2.3 Automatic Data Collection

2.3.1 Our software products and our website may collect play session data automatically. Play session data includes high score entries, replays, achievements and stats.

2.3.2 Anonymous error reports are collected automatically by our software products.

2.3.3 Data regarding your device, including its public network address and browser information may be collected by our servers.

3. Why We Collect Data

3.1 Compliance

3.1.1 We may request personal information from you in compliance with trade, consumer, tax and privacy regulations.

3.1.2 2dengine operates within certain territories as determined by applicable law. Your country of residence and network address are used to determine if our services are available within your region.

3.1.3 Our website is designed to accommodate persons of all ages. You may be asked to confirm your age group to ensure compliance with several different regulations.

3.2 Security

3.2.1 The credentials related to your account are used for the purposes of authentication and authorization.

3.2.2 Your e-mail address may be associated with your profile and can serve as a recovery option for your account. Your e-mail address may also be used to receive messages and notices.

3.2.3 If you choose to purchase any of our paid products your billing information may be used to issue an invoice. Your payment information is handled separately by our partners.

3.2.4 Our servers collect data regarding your device which may be associated with your profile. Your network address and browser information are used to ensure the security of your 2dengine account.

3.3 Social Functions

3.3.1 Some of the collected information may be shared online as part of the social experience. The nickname and avatar picture associated with your profile are public and may appear throughout our website or within our software.

3.3.2 2dengine distributes User-Generated Content including voluntarily provided translations used for the localization and internationalization of our website and software products. User-Generated Content shall not include any personal information.

3.4 Quality Assurance

3.4.1 Some of our software products generate anonymous error reports which are collected for the purpose of quality assurance.

4. How We Process and Store Data

4.1 Cookies

4.1.1 Our website may save data on your device in the form of cookies, local storage and indexed databases. Data stored locally remains almost exclusively on your device except when necessary to keep your profile signed in between visits. Certain features on our website may not work properly if your device does not allow client-side storage.

4.2 Servers

4.2.1 2dengine uses a combination of open source and proprietary technology to process your data. Only some of the processed information is stored by our servers.

4.2.2 Nearly all traffic passing through our website is encrypted using Transport Layer Security. TLS is a cryptographic protocol that provides end-to-end security of data transferred between you and our servers.

4.2.3 The sensitive information of Users is encrypted during storage.

4.2.4 The data we process on the server-side is stored with the help of our partners Digital Ocean. Data is distributed on the cloud across varying physical locations. Most of the information that we collect is stored at NYC1 Data Center located in New York City, United States.

4.2.5 Domain related services (including DNS and DMARC) for our website are provided by the ICANN accredited registrar Porkbun.

4.3 Payment Processing

4.3.1 Your payment information is handled by one of our partners whereas your billing details remain exclusively in our books. Our payment processing partners include Stripe and PayPal.

4.4 Communication

4.4.1 E-mail messages including account recovery codes are delivered with the help of our partners, Zoho Corp.

4.4.2 2dengine sometimes sends physical letters, postcards or ships packages to selected customers. In such case, your name and address may be shared with one of our logistics partners. You can review a list of our current partners here: 2dengine.com/about

5. What Are Your Rights

5.1 Local Regulations

5.1.1 Your privacy rights vary depending on applicable law and may be determined by your location.

5.1.2 Residents of California have statutory rights as defined in the California Consumer Privacy Act. You have the right to know what data is collected about you and how that data is used. You have the right to access, correct or delete your personal data. Additionally, you have the right to opt-out of data sales, marketing, profiling, automated decision making and certain types of processing. Your personal data shall be disclosed to you in a structured and portable format. You shall not be discriminated against for exercising your privacy rights. 5.1.3 Residents of the European Union have certain rights as defined in the General Data Protection Regulation. 5.2 Messages and Notifications

5.2.1 Recently introduced legislation mandates the delivery of data breach notifications to our Users and other affected parties. Depending on the contact information that you have provided to us, you may be notified of significant data breaches affecting our services in one of several ways. 5.3 Exceptions

5.3.1 Despite your right of erasure, invoices containing your billing information may remain in our accounting books for up to 4-7 years in compliance with tax regulations.

6. What Are Your Responsibilities

6.1 Children's Privacy

6.1.1 The 2dengine software along with our website are intended for individuals of different ages. Users shall confirm their age in order to access certain features. Depending on your specified age, your account may be restricted from: accessing certain products or content, customizing your profile.

6.1.2 2dengine may restrict or suspend accounts of users who fail to provide true and accurate information regarding their age.

6.1.3 If you under 13 years of age and would like to unlock age-restricted features, please ask your parent or legal guardian to contact us.
