Thomas Sowell walked into the Bork confirmation hearings in September 1987 wearing a gray suit and a red tie, sat down in front of the Senate Judiciary Committee, and did what very few people in that room could anticipate. He decided not to play along.

The chairman leading the hearing was Senator Joe Biden of Delaware. Biden tried to portray Judge Robert Bork as a man opposed to civil rights, and he pressed Sowell — a Black economist — to help prove that. Biden asked him if there were “enough” qualified Black students to occupy spots at places like MIT and Harvard. It was a loaded question dressed up to look like a factual one. Sowell didn’t flinch.
