This is The Red Line

When everyone asked, “where is the red line?”, this is it. Here and now. We have reached that red line.

It started with ICE raids.
Hundreds detained across Los Angeles. Families torn apart in the middle of the night. Homes kicked in. Children left to wonder if they’ll ever see their parents again. It’s a nightmare this country has seen before, but this time it’s different. This time, it’s coordinated with something far more sinister.

When communities rose up in protest, trump didn’t just try to silence them. He bypassed California’s governor and deployed the National Guard against American citizens. Governor Gavin Newsom never gave approval. That alone makes it illegal. But this isn’t a blunder or a misunderstanding. It’s a blueprint.

trump is escalating deliberately. He’s manufacturing chaos so he can point to it and say, “See? This is an insurrection.” Because if he can call it that, he can invoke the Insurrection Act.

Here’s the terrifying truth. The Insurrection Act is an ancient law passed in 1792 and last updated in 1874. It’s full of vague language and loopholes that let a president send in the military against U.S. citizens if they claim there’s a rebellion or unrest. And the worst part? In an 1827 Supreme Court case, Martin v. Mott, the Court ruled that it’s entirely up to the president to decide if the Insurrection Act should be used, and the courts cannot review or overturn that decision. Once it’s invoked, the judicial branch is locked out. No checks. No balances. No reversals. Katie Phang gives a more in depth analysis:

As the Brennan Center has warned, “The problem is that the Insurrection Act creates a giant loophole in the Posse Comitatus Act rather than a limited exception to it.” This loophole allows the president to bypass long-standing protections that separate military power from domestic policing. That’s the exact wall trump is trying to break through.

And he’s not stopping there. trump has already floated invoking the Alien Enemies Act by claiming the Venezuelan Tren de Aragua gang is invading the country. This is the same strategy: fabricate a crisis, then use it to strip away rights and justify mass deportations, military crackdowns, and total control.

This isn’t law and order. This is lawlessness with a badge.

Governor Newsom confirmed in an interview with Brian Tyler Cohen that California will be filing a lawsuit this morning to challenge trump’s deployment of the National Guard. It’s a necessary move, but legal action takes time, and time is exactly what trump is trying to run out.

If the Insurrection Act is triggered, your right to protest could vanish overnight. People could be arrested for nothing more than standing in opposition. And under the law as it stands, there would be no legal recourse until trump is removed from office.

That means Congress needs to act immediately.
The House must file articles of impeachment.
The Senate must prepare to convict.

This is not hopeless. In South Korea, peaceful mass protests and constitutional accountability led to the impeachment and removal of a corrupt president. It can happen here. But not if we wait. Not if we let fear or fatigue win.

They never were.
But the only way to prove it is to show up.
