For the last eight years, we watched the ebbing and initial turning of the tide—no wonder the small far radical left concentrated in their blue urban bubbles is burning their cities to the ground and rioting so much.

The 2017–2025 era was defined by a specific kind of kinetic energy: the 6–3 Supreme Court realignment, the shattering of Chevron, and the initial DOGE shock that finally proved the federal workforce could be cut. In Article 4 of this Democratic Power Index (DPI) series, we documented that historic inflection—the first tiny measurable retreat of the administrative state’s headcount and regulatory volume since World War II. The “Plateau” in the Administrative State Power Index (ASPI) & DPI bands finally gave way; the “Apparatus” and they both began to revert to the pre-FDR mean.

While the regulatory tentacles are retracting, the structural concrete is hardening. The lesson of late 2025—where record workforce cuts were met with rising federal spending—revealed the deeper, darker reality of the unelected and unaccountable (and unconstitutional) Fourth Branch. It is no longer just a regulatory police state; it is now a largely autonomous financial engine, driven by entitlement algorithms and debt service that no amount of personnel firing can touch.

We are entering the era of “Maps After the Last Map.” The gerrymandering room that has consumed far too much oxygen and space the past almost year now goes nowhere for Democrats and their leaders have known it is a massive defeat coming for many years now.

Just 35 weeks left until The Second Bill of Rights: A Blueprint for Constitutional Restoration is published on July 4, 2026! More examination of the ever-growing political, geographic, and cultural fractures unfolding and developing across our Republic—between cities and suburbs/countryside, blue and red, left and right—are coming soon.

The demographic sorting (a/k/a voting with your feet and pocketbook) is essentially conclusive and will just continue for years to come—this is the very reason for the mid-decade redistricting that red states finally decided to do after blue states did quietly for years under Obama—no wonder Democrats have no “powder” left with which to fight the Gerrymandering / Redistricting War last year and this year.

As has been well publicized for months now, the preliminary 2030 Census reapportionment data will punish blue states and reward red states, and these analyses are based on total resident population including legal aliens and illegal aliens, not solely US Citizens.

Analyses of US Citizen-only based reapportionment, migration demographics, and a few other notable factors (including SBOR Article the Second 1 Representative for no more than every 30,000 residents/US Citizens) will be undertaken here at The Second Bill of Rights on Substack in what is likely going to be a 10-part series starting either next week or the week after—get ready for all that excitement and insight! The 2030 Census maps for that are awesome, but the final 2040 Census map is the real gold mine!

The fluidity of the last decade is being replaced by a rigid, high-friction standoff. The question for 2026 through 2033 is no longer if the Fourth Branch can be checked—we know now that it can be. The question is whether the constitutional container can survive the pressure building inside it: a $52+ trillion debt reality, a politicized central bank, and a political map where the lines can no longer be redrawn to release the pressure.

The “Rollback” is over. The “Showdown” has begun.

We still have the DPI graphic from November 2025 for now though. A month from now, we will have the first real update to it: the final actual piece of the 2024 ASPI inputs ought to be published closing the books finally on 2024; the first of the 12/31/2025 data ought to be available too; and the first of the 2026 data will be pinned down! Excellent!

So, we will have a 2026 column in early March 2026. Stay tuned!

Please remember that in the current DPI graph the four ASPI-related rows for 2024 are still based on one remaining 2023 figures (CFR pages), and for 2025 are based on one 2023 figure, one 2024 figure, and an as of 11/15/2025 updated projection. Expect those final published numbers once published to pull down each of those rows from what you see here. That, in turn, will pull down ASPI and DPI for 2024 and 2025. Ready to ride herd?

Before we project the 2030s, we must look at the mixed lesson of 2025. The Department of Government Efficiency (DOGE) produced the single largest peacetime workforce cut in history—slashing the federal headcount by 9% in under 10 months.

Why? Because the Fourth Branch is not just personnel; it is an autopilot money engine. As The Cato Institute noted in their recent analysis, while the Federal workforce was reduced some, entitlement spending (Medicare/Social Security/Interest) ballooned by $248 billion in the same period. The lesson is stark: the “Soft” Fourth Branch (the people) can be fired, but the “Hard” Fourth Branch (the mandatory spending algorithms) continues to grow.

The Ten SBOR Amendments

While DOGE provided the external pressure, 2026 is defined by the internal warfare being waged by the Office of Management and Budget (OMB) led by Russ Vought. Finally, another person in power playing by the same rules that Marxists always play by—traumatize them or else they will traumatize you for sure without thought or hesitation.

Recognizing that the Republican hold on the House is tenuous heading into the November 2026 midterms, Vought has shifted from mere “efficiency” to a “scorched earth” structural dismantling. The strategy for 2026 is no longer just about saving money; it is about aggressively testing the limits of impoundment—refusing to spend appropriated funds on unauthorized or “woke” programmatic infrastructure—and reclassifying protected civil servants to strip agencies of their institutional memory before a potential hostile Congress in 2027 can intervene.

This is a race against the clock. The OMB is using 2026 to “salt the fields” of the administrative state—stripping agencies of their regulatory independence and funding streams so thoroughly that even if the House flips in November, the bureaucracy cannot simply grow back.

This sets the stage for the true crisis inevitably coming so very soon now. Vought and DOGE are successfully hollowing out the administrative apparatus, effectively checking the regulators. But they cannot check the compounding interest or the demographic tidal wave.

This is the critical setup for the next decade: The war against the personnel (2025–2026) is being won, but we are still losing the race against the math (2033+).

As we move into the late 2020s, the battle shifts from cutting heads (DOGE/personnel) to rewiring the machine (Constitutional structure). The central question becomes:

  • The fight over Chevron/Loper Bright and Jarkesy (I love the Seventh Amendment!) was just the warmup. The real battle is over the existence of “Independent Agencies” and Administrative Law Judges (ALJs) themselves.

  • The Core Question: Where in Article I is Congress authorized to delegate judicial power to executive agencies? Where? Where is the “necessary and proper” clause for creating a permanent, unaccountable bureaucracy? Where?

  • The Watch Item: We are waiting fervently for the specific test case—likely from a targeted industry litigant—that challenges the very existence of ALJs as a violation of Article III and the Separation of Powers.

When will someone bring that lawsuit? It is the inevitable next step after Loper Bright. Let’s get to it for crying out loud!

The Democratic Ceiling: Demographic sorting and the 2030 Census projections make it seemingly mathematically impossible for the Democratic Party to hold a durable, structural majority anytime soon. They are geographically inefficient and tapped out in addition to being ideologically and morally bankrupt.

The Republican Floor & Ceilings?:

  • The 240 Baseline: The 2030 Census reapportionment (total population based) already pushes the GOP map close to a structural 240-seat majority.

  • The “US Citizen-Only” Accelerant: If the 2030 reapportionment is successfully litigated to be based on US Citizens only, a 240+ seat floor for Republicans becomes a statistical certainty.

  • The 261 Spike: Can the GOP reach 261 seats (60%) though? That is the minimum threshold for any sort of legislative dominance. At that level of power, House leadership has 43 caucus votes it can “lose” and still pass legislation requiring a simple majority. We will explore the plausibility of this “Minimum Majority” scenario in the forthcoming 10-part SBOR series starting either next week or the week after.

  • The 2/3rds-Majority 290 Aspiration: Real majority power begins at 290 seats in the US House. At a 2/3rds-majority, House leadership now has 72 caucus votes it can “lose” and still pass legislation requiring a simple majority and the ways to achieve that become more along the lines of what the basic math combination formula (often called “n choose k”) calculates out the options to be—approximately 2.078 x 10^70 different ways to 218 votes—this number is incredibly large—it is roughly one ten-billionth of the total number of atoms in the observable universe (10^80). Ask Speaker Mike Johnson and others if they can even fathom that ability.

Seriously, I want to sit down with Speaker Johnson and the other current House leadership and plumb their ability to even imagine such room to maneuver and achieve legislative success.

Who is up for helping me do so in say April 2026???

  • The “FDR in 1937-1939” 334 Real Goal: What is this insanity of which I speak? 334 US House seats for one party??? No way! Never! Yes way! FDR had that many Democratic US House seats in the scariest Federal legislative year in our Republic’s history—Speaker William B. Bankhead, Majority Leader Sam Rayburn, Democratic Whip Patrick J. Boland, and Democratic Caucus Chairman Robert L. Doughton had 116 caucus votes they could “lose” and still pass legislation requiring a simple majority—approximately 2.146 x 10^92 (again using the basic math combination formula) different ways to 218 votes—about one trillion trillion times larger than the total number of atoms in the universe!

Go look at the list of legislation passed in the 75th Congress. You suggest the “term” you think best describes all that Marxism.

  • Central to Fourth-Branch power is the Federal Reserve’s balance sheet, which increasingly finances regulatory sprawl and blurs the line between monetary policy and fiscal governance.

  • The Constitutional Challenge: Just as with independent agencies, the constitutionality of the Fed itself must be challenged.

Who will bring that lawsuit? Let’s get to it too for crying out loud!

  • The Solution: This is the specific focus of Article the Eighth of The Second Bill of Rights. The goal is not “audit the Fed”—it is to permanently end it as an unconstitutional delegation of Congress’s power of the purse.

  • The Spirit of 1832: We need the ghost of Andrew Jackson—founder of today’s Democratic Party! The bank war of the 1830s is the only historical precedent for what must happen next: the total revocation of the central bank’s charter to restore sovereign fiscal power.

I did a report on President Jackson in elementary school that I still remember doing quite well—maybe 3rd or 4th grade (1976-1978)—was that the real start of The Second Bill of Rights??? And, my The Second Bill of Rights image from the must-read “Thomas Jefferson/Swamp Hydra/Can-Kicking” article from last August are essentially identical. Awesome! Spooky! Obvious?

But it’s 194 years later and we are still fighting the same damned hydra—The Second Bill of Rights will bring that to an end though soon.

Demand The Second Bill of Rights! Accept no substitutes!

  • The composition of the Federal Appellate and District Courts (COAs/DCTs) will continue to shift back toward the GOP via retirements and confirmations—Biden was only able to move them back to almost a 50/50 ideological split—cementing the Loper Bright era and ensuring the judiciary is receptive to the structural lawsuits mentioned above.

By 2028, all gerrymandering room will be effectively exhausted as I and others have demonstrated for almost a year now—push my last Gerrymandering / Redistricting War table from right before the 2025 elections one notch further towards Democrats now in complete control of the Commonwealth of Virginia and the net to the GOP is still a whopping +16 seats.

You can only stretch a district line so far before it snaps back or runs out of voters entirely.

That new CA-01 district is the best—ha! Seriously though, that “tail to Marin County” puts those ultra-blue urbanites in the same district with the folks living on Surprise Valley Road and Bigfoot himself—rationalize that to everyone, Gavin Newsome!

The 2030–2032 period shifts to a new, darker phase: Maps after maps.

Don’t get tired of hearing, saying and voting it: The results of the 2030 Census will go far more to the GOP than Democratic leadership and talking heads are willing to admit. We are looking at a structural decapitation of the old Blue Wall. Based on current trends, it currently looks like a massive 15-seat shift of political power:

  • The Losers: California (-5), New York (-3), Illinois (-2), plus single-seat losses in Michigan, Minnesota, Oregon, and Pennsylvania.

  • The Winners: Texas (+4), Florida (+4), and single-seat gains in Idaho-Utah-Arizona and Tennessee-North Carolina-South Carolina-Georgia.

Critical Note #1: These projections are currently based on total population (including legal and illegal aliens). If the litigation strategies we discuss below succeed in moving the 2030 reapportionment to a US Citizen-Only basis, that 15-seat swing could easily accelerate to 20 or more.

Critical Note #2: Push gerrymandering and redistricting before the 2028 Elections to the extremes like we just covered a few paragraphs ago and maybe 16 more seats are already in the GOP column before the 2030 reapportionment even happens—under that scenario, the GOP starts the 2032 House election cycle in the ~250+ seat vicinity.

Whatcha gonna do, Democratic leaders and globalist goon financiers? Anyone with any sense knows you have known this math for a few years at least. Whatcha gonna do?

Because the raw numbers are so devastating to the radical left, the fight will move from “drawing lines” to “defining the rules.”

  • Apportionment Basis: The “Total Population vs. US Citizen Population” fight will be the Roe v. Wade of the 2020s. The nouns used in our Constitution and its Amendments are inconsistent, but originalist interpretation may narrow them.

I will tear apart those nouns in another article soon enough.

  • “Maintenance” Lawsuits: Expect aggressive litigation over another round of “inter-decade” map tweaking to account for rapid population drift (e.g., millions more fleeing Blue states for Red states after the 2030 Census is locked).

  • Data Obfuscation: Watch for battles over “Differential Privacy” rules—algorithms used by the Census Bureau that can conveniently blur block-level data in ways that protect under-counted urban populations.

Maybe a bigger math nerd than me would care to weigh in on why anyone would use “Differential Privacy” and its intention injection of “noise” into the real raw data instead of just making the blasted Census blocks sufficiently big enough geographically to make any individual privacy concerns vastly smaller.

Wyoming does NOT need to have 53,769 Census blocks for only 576,851 people—30,912 of those Census blocks have exactly ZERO people in them—57.5% of all the Census blocks in Wyoming have absolutely no purpose whatsoever—the 8,561 Census blocks that have under 10 people in them can easily be dealt with—7,458 more Census blocks have between 10 and 24 people in them—do those need to be fixed too? Beats me. Why do two Census blocks in Albany County (Laramie) have 1,200 and 1,600 people in them? And, there are 811 Census blocks with triple digit people in them. Get to slicing and dicing instead of intentional injecting “noise.” Math nerd us all up, ultra math nerds!

I will report back to everyone in a comment to this article on New Hampshire’s Census block population extremes when I start to dive into all that hopefully this Friday.

We have been witnessing the hardening of Two Americas for at least a decade or more now—not just ideologically, but physically.

  • The Urban/Rural Mythical Split is Dead: It is now deep blue urban bubbles (DC, LA, SF, NYC, Chicago, Minneapolis, Atlanta, etc.) vs. vast red expanses (suburban, exurban, and rural America). The middle ground has geographically vanished.

  • The Suburban Wall: Over 50% of our citizenry now lives in the suburbs, and hasn’t your patience run out? How much more appetite for the chaos, violence, arson, assaults, murders, and radical leftist Marxism that defines the blue urban cores just a few miles down the road from you do you want to put up with?

  • The Result: The suburbs are less and less swing territory; they are becoming fortress territory—communities voting explicitly to keep urban decay and guaranteed doom locked up miles away in the city far away from their children, parents, and peaceful, thoughtful and realistic lives. Go figure! People tend to vote against the policies that turned their neighboring cities into war zones.

Pillar #2 of The Four Furtherances (Linear Politics & the 2024 Election Results) is nearing completion and will showcase just how few blue urban bubbles and dots we have to deal with to end their tantrums and destructiveness.

The next Red Land, Blue Flame article is entitled “Outbreak! Minneapolis 2026” (another version of the VERY popular Outbreak! Chicago 2032” article that I keep pitching in my dreams to be turned into a real screenplay and movie! ha!) and it too will show just how localized the blue urban mental plague is in the Land of 10,000 Lakes—it’s only three little dots, folks. Three little blue urban dots.

By 2033, the Plateau we see today will likely break—one way or another. We are moving from the era of “kicking the can” to the era where we run out of road to keep kick the can down.

The most important fact about 2033 is not who is President, but what is insolvent. The Medicare and Social Security trust funds hit their statutory insolvency dates during that presidency.

  • The “Auto-Pilot” Reality: We are not facing a political choice; we are facing a mathematical certainty. By 2033, mandatory spending (entitlements + interest) will consume 100% of all federal tax revenue.

  • The End of Discretionary Government: This means the entire “government” as you know it—the military, the border patrol, the FBI, the courts, the roads—will be funded exclusively by new debt.

  • The $52+ Trillion Crowd-Out: With our national debt surpassing $52 trillion most likely by Inauguration Day 2033, interest payments alone will exceed the entire Defense budget. We enter a “death spiral” where Washington, D.C. must borrow just to pay the interest on what it already borrowed. Fiscal crowd-out becomes the only governing reality: there is no money left for “policy.”

Another way to look at this reality is to remember how far off the date for this inevitability used to be in the future in the late 20th century, then the 2000s, then the 2010s and now in 2026. What was once 20+ years away then became 15-20 years off, then 10-15 years down the road, and just last year (2025) it fell to under 10 years for the first time ever. That ever-decreasing time to inevitably falls to under 5 years during the presidency of whomever wins Election 2028.

Whatcha gonna do?

As the fiscal crisis hits, the Federal Reserve will be forced to shed its mask. It will no longer be a “central bank”; it will become the Lender of Last Resort for Fiscal Suicide.

  • The Monetization Trap: With the bond market refusing to buy US debt at sustainable rates, the Fed will be pressured to step in and buy the debt itself (monetization). This will be our “Weimar Republic moment.”

  • The Constitutional Crisis: This creates a singularity where a part of the Fourth Branch (the Fed) effectively swallows the Power of the Purse (Article I). The bureaucracy will be printing money to fund itself, bypassing the consent of the governed entirely.

Let’s identify a few pieces of litigation for that near-enough-term inevitability. Who will bring them though?

  • Zero Political Capital: This expansion of power will happen exactly when the public’s trust in the Fed hits absolute zero. They will not be seen as “technocrats saving the economy”; they will be seen as counterfeiters saving the Swamp Hydra.

Everyone in Washington knows the dirty secret of 2025: DOGE was a success, but it revealed the limit of the scalpel.

  • The Lesson of 2026: We proved that even if you fire 9% of the workforce (cutting the heads off the Swamp Hydra), new heads keeps growing. Why? Because the statutes remain.

  • The Cauterization Necessity: As long as the authorizing legislation exists, the “programs” are on auto-pilot. You can fire the bureaucrat, but the algorithm cuts the check. The Swamp Hydra simply regrows two heads—often in the form of “contractors” or “automated compliance systems”—for every one we hack off.

Who will be our Heracles to do the head severing though? And, even moreso, who will be our Iolaus to do the cauterizing?

  • The 2033 Imperative: The next phase isn’t about “waste, fraud, and abuse.” It is about Repeal, Revoke, and Rescind. If you don’t burn the root (the statute), you cannot kill the weed.

The risk of genuine systemic rupture—a constitutional financial crisis, a secession crisis, and open civil conflict—are quantifiable.

  • The Trend Line:

    • 20-25% Risk Today: We are already in the Red Zone of polarization. We moved up into this risk level area this past summer easily and quickly.

    • >50% Risk by 2033: When you combine the fiscal collapse with the demographic sorting and the judicial deadlock of the Judiciary striking down unconstitutional acts that a zombie Congress refuses to fix and a hostile Bureaucracy refuses to stop (both of which we covered earlier in this article), the system simply cannot hold.

  • The Indignation Curve: This is the accumulated momentum of public fury. It traces a direct, rising line:

    • Election 1968: The fracture of the cultural consensus.

    • Election 2016: The populist rejection of the managerial elite.

    • Election 2024: The mandate for dismantling the state.

    • Post-Inauguration 2033: The Explosion.

When each of us realizes that our savings have been inflated away to bail out the very system we have voted to dismantle for decades, our social contract is void. That is when the Indignation Curve goes vertical.

For the first time ever, the Democratic Power Index (DPI) is on the verge of reverting back to the pre-FDR mean in both statistical and real-world terms. But let us be clear: This is not the end of the danger; it is the beginning of the most dangerous phase.

The drops we barely can see so far in the most recent few years ASPI were just the initial shock—the system reacting to a distinct electoral mandate. The period of 2026–2028 is the Danger Zone. This window will determine if the reform movement can hold the line against the administrative state’s inevitable counterattack.

The Deep State does not vanish quietly; it retrenches, litigates, and sabotages. It NEVER plays honorably or fair, so it must be dealt with by Citizens willing or more than happy to deal with it like that too.

As more and more Citizens like that populate the ranks of governments local to Federal, be careful and remain situationally aware. Do all you can to make sure you aren’t in the wrong place at the wrong time too often.

Everyday Situational Awareness in 2025

If the debt and entitlement curves are not severed, the Indignation Curve will force a resolution for us by 2033. Our Republic simply cannot sustain hyper-centralization and $52+ trillion in debt simultaneously. We are barreling toward a forced political mean reversion—a return to a historically restrained federal balance where States’ Rights and Tenth Amendment originalism are not just legal theories, but survival mechanisms.

For those who still refuse to see the writing on the wall—the low-single-digit, ultra-loud blue urban dot minority who believe they can scream, whistle, and arson the math away—their time to reckon with reality likely passed years ago. When our system cracks currently most likely during the 2033-2037 presidency, the cultural and economic space for their radical collectivism will not exist and life will be very dangerous to them, I bet. We all know that they will not (or cannot) recognize this and it will play out for them just as it did for Loyalists to King George III in the late 1700s: finding themselves lucky to be alive and strangers in a country that no longer recognizes their claim to power.

RLBF: When The Bear Wakes

Between now and then though, Pillar #4 of The Four Furtherances is their best viable option, but everyone has to wait a few more weeks for me to finish and publish that warning shot across their bow of an opportunity they ought to immediately take up. Be patient, please! It will be worth it!

So, here we are now . . . we have spent five articles and almost 25,000 words diagnosing the Washington, D.C.-Swamp Hydra rot. We have mapped the impending DPI collapse, the censorship industrial complex, the demographic sorting, and the fiscal suicide pact of the Fourth Branch.

But diagnosis is not a cure.

The 20th-century playbook is dead. The numbers require a new constitutional settlement—one that does not rely on “better personnel” (my, how Wilsonian!) but on better architecture.

Naturally, it’s The Second Bill of Rights!

In the final installment of this series, we stop “admiring” the problem and start dismantling it. We will go into another layer of analysis and discussion of The Second Bill of Rights.

The Second Bill of Rights’ Blueprint: We will detail Article the First through Article the Sixth—the specific, non-financial structural reforms designed to break the administrative state forever.

Seven months ago, the bear was already awake. The bear was hungry. Its paw was already in motion. History keeps tallying the real score even when people in urban blue dots refuse to read the ledger.

The bear was poked for far too long enough, and the bear came for them.

The Democratic Power Index (DPI) is a rigorously constructed, four-branch composite—capturing President, Congress, all three federal judicial layers, and the Administrative State—that distills almost a century of institutional flux, expansion, and interplay into a single evolving graph. From FDR’s Triple Shield era (1937–1994), the Fourth Branch expanded unopposed. After 1994, Republican majorities never regained supermajority legislative or judicial control, so bureaucratic rollback was only possible via executive orders and, increasingly, Supreme Court interventions. Now, with the first tiny downturns in ASPI and DPI—driven by shrinking regulatory outlays and new judicial realignment—the evidence is finally more than punditry: the direction of federal power is changing in real time, not just in imagination.   1. The “Hard” Fourth Branch Reality Check: The 2025 data prove that even the largest workforce reduction in history (DOGE’s 9% cut) couldn’t stop federal spending from rising because the “Hard” Fourth Branch (entitlements and debt service) is on statutory autopilot. Since “efficiency” is mathematically insufficient to stop a likely $52+ trillion debt collapse circa 2033, are you truly prepared to support a scorched earth repeal of the popular statutes that drive this spending, or will you blink when the “cauterization” process begins to hurt?

  2. The US Citizen-Only Accelerant & Blue Collapse: If the 2030 Census is successfully litigated to reapportion US House seats based on US Citizens only—potentially shifting 20+ seats to Red States and rendering the Democratic Party a permanent minority—what might the reaction of the blue urban dots look like? When a ruling class for almost 100 years realizes it has been mathematically locked out of power for at least a generation, do they accept the mean reversion, or does the "Maps After the Last Map" era transition from political maneuvering to overt asymmetrical secessionist conflict?

  3. The Post-Fed Withdrawal Symptoms: This article argues that the Federal Reserve must be challenged as an unconstitutional delegation of the "Power of the Purse" and that its charter must be revoked. (Don’t worry though . . . Article the Eighth of The Second Bill of Rights ends the Fed cleanly and outright.) If the "money printer" is successfully killed and sovereign fiscal power is returned to our directly elected and easily replaceable) House of Representatives, is a sufficiently large enough percentage of the US Citizenry actually resilient enough to survive the immediate, massive withdrawal symptoms of a non-manipulated economy, or will the pain of true price discovery drive the electorate right back into the arms of the Swamp Hydra?
