Three months later, the presiding judge, the chief judge of Maryland, issued a 93-page opinion overturning the jury’s verdict entirely, acquitting Dr. Ron on all counts and stating that “the government did not carry its burden and no reasonable jury could have so concluded” and that “the evidence weighs so heavily in favor of the defendant... that it would be unjust to enter judgment against him.” The judge further guaranteed Dr. Ron a new trial should the government appeal. Weeks before President Trump’s inauguration, the outgoing Biden DOJ did exactly that, appealing the acquittal and forcing Dr. Ron into a second criminal trial. Notably, the American Medical Association, an organization Dr. Ron has never belonged to, filed an amicus brief in his defense, pointing out the irony that the AMA itself wrote the coding rules the government accused him of violating.

He also cites the case of Dr. Sankar Kumar, an OB-GYN and board-certified oncology surgeon in rural Tennessee who primarily treated low-income and Medicaid patients. Prosecutors initially charged Dr. Kumar with rape for performing hysteroscopies, a standard diagnostic procedure, before quietly dropping that charge, a move Dr. Ron believes was designed purely to taint the jury pool. Dr. Kumar was ultimately sentenced to twenty years in prison.
