Multiple recent articles and official announcements confirm that the Trump administration’s Treasury Department / FinCEN has finalized a rule permanently ending beneficial ownership reporting requirements for U.S. companies and U.S. persons under the Corporate Transparency Act, and that it will delete previously collected data on those entities from its database. Former Rep. Tom Malinowski (who helped pass the underlying law) has publicly described this as helping international criminals, likening the data deletion to destroying an investigative tool (e.g., an FBI fingerprint database), and noted that the deletion could hinder law enforcement—including state investigations—and may be irreversible. The Trump Admin is permitting/hiring PRIVATE companies to “infiltrate international cyber criminals.” There are some major problems with this new attempt to dance past the Fourth Amendment and towards another police state touchdown. First, not only does the Constitution require a judge-issued public warrant citing the person to be searched and the item sought before any branch of the govt searches someone, the govt doesn’t get around this by hiring proxies. It cannot hire them under a strict reading of the Constitution. Second, as you will see in the article linked, the government (and writer of the piece) depict their targets as guilty before even being charged with a crime… “‘Cyber privateers’: Trump issues order allowing US companies to hack overseas groups under certain conditions” LINK
The National Security Presidential Memorandum titled “Expanding Capabilities to Combat Transnational Cyber-Enabled Crime,” signed by President Trump on August 12, authorizes a program under the National Coordination Center (Homeland Security Task Force) in which vetted private US companies can conduct “Cyber Surveillance Operations” and “Cyber Effects Operations” (“disruption, degradation, etc.” - in other words, SABOTAGE) against these targets, but only under direct federal government control, oversight, written approval by co-Executive Directors from the Department of Justice and Department of Homeland Security, and as “part of lawful investigatory, protective, or intelligence operations by federal law enforcement.” But, since these are conducted without warrants and the cyber attacks the feds okay are done without trial, this is just cyber piracy and gangsterism. The key definition (Section 4) is:
“Cyber-Enabled Transnational Criminal Organization (CE-TCO)” means any foreign group that conducts cyber-enabled crime against the United States Government, a United States person, or United States interests, and that is not an institutional part of a foreign government or wholly operated under a foreign government’s direction. For the purposes of this memorandum, a foreign group will be assumed not to be an institutional part of a foreign government or wholly operated under a foreign government’s direction unless clear intelligence exists establishing such connection.
News coverage of the memo (including the MSN/CNN-style pieces using the “cyber privateers” framing) consistently describes the targets as foreign criminal groups, cybercriminals, or TCOs “responsible for ransomware, phishing, financial fraud, sextortion, and similar activity that has cost Americans large sums (the White House cited more than $20.8 billion in reported losses to cyber-enabled crime in 2025).” These descriptions track the memo’s language of groups that “conduct” such crimes; they do not claim or require prior US court convictions, nor any actual court process. The government and their hirelings can just make the claim, any time.
Implementation details (to be fleshed out in procedures within 60 days, with some elements in a classified annex) include an “adjudicatory framework” to ensure operations target only CE-TCOs, standardized rubrics/templates for target identification, threat information sharing from private entities and government agencies, deconfliction across agencies, and strict rules against targeting US persons/systems (with minimization and notification if that occurs, plus judicial authorization where constitutionally or legally required for US persons). Operations must comply with the Constitution, US law (including the Computer Fraud and Abuse Act via government authority), and applicable international obligations. There is no public language requiring a criminal conviction or completed court process as a prerequisite.
