To add more follow-up to the follow-up. We noted two days ago the major data set missing from Stephen Moore’s claim that US “ability to afford” is up — that data set being the number of people who are either unemployed or are no longer looking for work. That has an effect on the calculation output, because it’s a data pool skewed towards only those who are working. Here is the stunning information on the labor participation rate.

Everything he said was false. Oil prices are up today. As of recent trading (afternoon updates):
WTI (West Texas Intermediate) crude: approximately $82.24 per barrel, up about 1.22% (roughly +$0.99) from the previous close of around $81.25.
Brent crude: approximately $88.55 per barrel, up about 1.70% (roughly +$1.48) from the previous close of around $87.07.
Comparison to January 2025In January 2025, monthly average spot prices were:
WTI: $75.74 per barrel.
Brent: $79.27 per barrel.
Today’s prices are higher than the January 2025 averages:
WTI is up by roughly $6.50 (about 8–9% higher).
Brent is up by roughly $9.30 (about 11–12% higher).
This is unsustainable.

The current removals (or indefinite suspensions) of the de minimis exemption for low-value imports (generally under $800) were carried out under discretionary presidential authority that Trump claimed and exercised primarily through the International Emergency Economic Powers Act (IEEPA), rather than under a statute from Congress that had already taken effect to end the exemption. Key details:
Trump issued a series of executive orders (beginning in 2025, with later continuations) invoking IEEPA. Under 50 U.S.C. § 1702(a)(1)(B), the President may “nullify [or] void … any … privilege” with respect to property in which a foreign country or national has an interest during a declared national emergency. The court treated the longstanding de minimis exemption (codified at 19 U.S.C. § 1321) as such a “privilege.”
On August 13, 2026, a three-judge panel of the U.S. Court of International Trade upheld this action. The court held that IEEPA authorizes the rescission because it voids a privilege without constituting an exercise of the congressional power of the purse or the power to impose new tariffs. It distinguished the action from the broader IEEPA-based tariffs that the Supreme Court had earlier invalidated (those created new duties; this merely subjects low-value goods to duties that Congress had already authorized in the absence of the exemption).
Congressional role?
Congress did act separately. The One Big Beautiful Bill Act (enacted in 2025) repeals the commercial de minimis exemption effective July 1, 2027. The legislative history explicitly states that this future repeal does not limit the President’s existing authorities (including under IEEPA) to restrict the exemption before that date. (Which is, of course, unconstitutional). LINK
