At current market valuations, this threshold captures less than 2% of institutional equity assets. The Nvidia disclosure arriving at $51B suggests the existing framework may have been structurally inadequate to flag this position earlier.
Art's Take: A $100M reporting threshold set in 1978 dollars is roughly $450M in 2026 dollars. The SEC is running a compliance framework designed for a market that no longer exists. Nvidia accumulated $51B in positions that required zero mid-quarter disclosure. That's the loophole. It's legal. It's also exactly the kind of fine print that costs retail investors money.
The CHIPS and Science Act's domestic content preference clauses require federal AI procurement to prioritize chips manufactured on U.S. soil. Intel Foundry Services is currently the only U.S. facility capable of producing advanced nodes at scale. Nvidia's $30B stake in Intel means that every federal AI contract awarded under CHIPS Act domestic preference rules now generates indirect equity value for Nvidia — creating a structural conflict of interest between Nvidia's government lobbying position and its portfolio holdings.
Art's Take: In logistics, we called this a captive supplier arrangement. The buyer and the vendor are the same entity — they just invoice each other. The CHIPS Act was designed to prevent foreign dependency in semiconductor manufacturing.
