Let's Do This: The People Who Protect Our Elections Have an Unbroken Winning Streak Against the Trump Administration

In 2025, Donald Trump signed an executive order that, according to the Brennan Center for Justice, “attempted to assert presidential control over significant aspects of federal elections.” While it would be difficult to summarize all of the many facets of this executive order (you can read an explainer from the Brennan Center here), the important thing that you should know is that Democratic state officials sued, and the executive order has largely been blocked in court.

So far in 2026, the Trump administration filed lawsuits against 30 states and the District of Columbia demanding that they turn over their unredacted voter files—including driver’s license numbers, partial Social Security numbers, and dates of birth. However, the state officials targeted by the Trump administration fought back in court, and have won every single time.

Notably, this is even though most of the judges ruling on the cases were appointed by Republican presidents, including almost half by Donald Trump himself. That last fact is worth keeping in mind whenever Trump administration figures trot out their tired “activist judges” talking point on these rulings. If they don’t like what they consider activist judges, then maybe they should stop appointing them.

Also in 2026, the postal service began the rule-making process on another executive order on elections from Donald Trump, this time one that squarely targets mail-in voting. Once again, Democratic state election officials sued, winning in both district and circuit federal courts. That executive order is now, at least of this writing, blocked nationwide.

With the midterm elections rapidly approaching, the Trump administration has appealed those rulings to the Supreme Court. Just yesterday, it issued a supplemental brief to its appeal, urging the Supreme Court to quickly unblock the executive order on mail-in voting. Once again, the legal team on the other side is a coalition of Democratic state officials.

You may have noticed a pattern here: Donald Trump is doing whatever he can to take control of our elections, and basically the only thing standing in his way are lawsuits from Democratic state officials. And, indeed, it has been every Democratic state official, no matter what faction or wing of the party they come from, no matter their age or how long they have been in office. Further, these Democratic state officials are carrying on this fight for the entire country, even if they only represent two dozen states. So far, they are undefeated.
