BREAKING: Supreme Court Lets Trump Target Mail Voting

Dear Room,

Just before 5 p.m. Eastern, six Supreme Court justices lifted a major block that had kept Donald Trump from moving forward with an order designed to put the federal government between you and your mail ballot.

The midterms are 71 days away.

North Carolina must begin mailing ballots to military and overseas voters on September 4. That is eleven days from now.

Justice Ketanji Brown Jackson said today’s ruling “needlessly injects chaos and uncertainty” into an election that has already begun.

Here is the line I cannot get out of my head:

The Supreme Court did not tell Trump he was right. It told everyone else they were too early to stop him.

What Trump ordered.

Trump signed Executive Order 14399 on March 31.

It directs the Department of Homeland Security to build a federal “State Citizenship List” for every state. The Justice Department is instructed to prioritize investigations and prosecutions of state and local officials who provide ballots to people the administration considers ineligible.

Then there is the Postal Service.

USPS finalized a 95-page rule last week that would require states to provide federal officials with the names of voters receiving mail ballots. States would also need to use new, federally approved envelopes and unique barcodes.

Under Trump’s plan, USPS could refuse to transmit mail ballots from voters whose names are not enrolled on the required lists. It could also reject ballot mail from states that do not comply with the new system.

One in three Americans voted by mail in 2024. Elderly people use it. Disabled people use it. Rural voters, college students, military families, hospital patients and people working multiple jobs use it.

Trump has spent years claiming mail voting produces widespread fraud, despite overwhelming evidence that fraud is rare. He has also voted by mail himself.

What the Court actually did.

The decision was 6-3.

The majority lifted an injunction protecting 23 states and the District of Columbia while the government’s appeal continues. The ruling came through the Court’s emergency docket, without the normal months of briefing and oral argument that would accompany a final decision.

The Court did not rule that Trump possesses the constitutional authority to rewrite mail-voting procedures.

The majority admitted that the measures his administration ultimately takes may still be unlawful. Its answer was that “time will tell.”

Another nationwide injunction, issued on August 11 in a separate case, also remains in place tonight. The administration may now challenge that order too.

So mail voting did not disappear at 5 p.m. Your ballot was not automatically canceled. Further lawsuits could still stop the plan.

But the Supreme Court removed one of the largest barriers standing in Trump’s way.

The contradiction.

The majority said states challenged Trump too early because the damage was still speculative.

Trump’s Justice Department simultaneously argued that the Court had to act immediately because the administration needed time to impose the changes before November.

Justice Sonia Sotomayor wrote that the government “cannot have it both ways.”

Justice Jackson was blunter.

She noted that the government never defended the underlying constitutionality of Trump’s order before the Court. No judge or justice, she wrote, has found the order constitutional.

Jackson described the situation as a “Kafkaesque nightmare.” Election cases can already be rejected for coming too late. Now, states are being told they also came too early.

The administration controls when the final rules appear. It can wait, keep the threat hanging over election officials, then argue there is no longer enough time for a court to intervene.

Jackson said the government’s objective appeared to be to “foment chaos” before November.

What this means tonight.

Do not panic, but do not ignore this.

If you plan to vote by mail, check your state election office directly. Request your ballot as early as possible. Return it early. Track it if your state offers tracking. Know whether you can use a drop box or vote in person if something goes wrong.

The rules may change again because this litigation is moving by the hour.

The headline version of this story is that Trump won.

The real story is stranger. Six justices let him move forward without deciding whether he has the power he claims. Three justices warned that the timing could throw an election into chaos. A second injunction remains, and the next emergency filing could arrive almost immediately.

That is why independent reporting matters. Somebody has to read beyond the alert, open the actual ruling and tell you what changed and what did not.

The quiet part.

Trump could not get Congress to give him the election system he wanted.

So he signed an order directing federal agencies to build it anyway.

Lower courts said the Constitution leaves election administration to the states and Congress, not the president. The Supreme Court did not disagree with that today. It simply decided the states could not stop him yet.

That word, yet, is carrying an entire election on its back.

The danger is not that every mail ballot vanished tonight. The danger is that the federal government is now closer to controlling which ballots the Postal Service will carry, while election officials have only weeks to understand rules that courts may change again tomorrow.

If you read this far, please restack this post. People are going to see headlines claiming the Supreme Court either ended mail voting or fully approved Trump’s order. Neither is accurate. What happened is complicated, frightening and important enough to get right.
