On the latest episode of The Blessings of Liberty, we’re sharing a great conversation I had recently with NPR legal affairs correspondent Nina Totenberg, moderated by Joanne Lipman, at a New York Historical virtual event. We discussed whether the Roberts Court is checking or rubbing-stamping President Trump; whether the justices decided cases based on judicial philosophy or partisan politics (Justice Breyer says the answer is political philosophy) and whether or not, as Nina suggested, this is a “corporatist” Court keeping an eye on the stock market.
