The Nationalist Case for the Ceasing of Family Law

In the current era, the sanctity and stability of marriage in America have been gravely compromised by the overreach of state intervention and the dilution of traditional values. The state's decision to equate same-sex marriages with heterosexual ones has fundamentally altered the definition and purpose of marriage, undermining its moral and natural form. To restore marriage to its rightful place in society, it must become a religious and personal act, free from state oversight.

However, the state's involvement in marriage, while initially intended to provide legal and financial benefits, has instead sown confusion and discord. It is for this reason that the apostle Paul stated in first Corinthians 6:1-8 in relation to believers quarrels amongst themselves

“If any of you has a dispute with another, do you dare to take it before the ungodly for judgment instead of before the Lord’s people? ² Or do you not know that the Lord’s people will judge the world? And if you are to judge the world, are you not competent to judge trivial cases?³ Do you not know that we will judge angels? How much more the things of this life! ⁴ Therefore, if you have disputes about such matters, do you ask for a ruling from those whose way of life is scorned in the church?⁵ I say this to shame you. Is it possible that there is nobody among you wise enough to judge a dispute between believers? ⁶ But instead, one brother takes another to court—and this in front of unbelievers!

⁷ The very fact that you have lawsuits among you means you have been completely defeated already. Why not rather be wronged? Why not rather be cheated? ⁸ Instead, you yourselves cheat and do wrong, and you do this to your brothers and sisters.”

Paul was right when he stated that the fact that we allow others to judge us by their standards and not ourselves by our Lords standards is a sign of the states victory and our own impotence. This means that the state decides what’s moral and what’s not. The state will punish you for disciplining your child and overlook adultery in the same breath. This is why state-sanctioned marriage runs anathema towards the Christian understanding of marriage. As a Christian, your marriage counselor, family court judge and government is your church and its denomination. Any truly Christian man wouldn’t leave the mother of his children and his children in poverty and would only need the judgment of God to keep him upright, not the judgment of a court with some arbitrary agreement that oftentimes doesn’t reflect reality. Divorce would really only exist in context of the case of adultery, in which case it should be permissible for the victim to cease all communication and take full custody of the children.

The existing benefits associated with state-sanctioned marriage, such as tax advantages, social security benefits, inheritance rights, health insurance, pension and retirement benefits, and joint property ownership, are undeniably valuable. These benefits, designed to support and protect married couples, should be preserved. However, they can and should be maintained under a new framework: the "public partnership."

Under the public partnership system, anyone who directly contributes, helps, or upholds your lifestyle can enter into a public partnership with you. This includes not just a spouse, but also caretakers, roommates, grandparents, parents, or any individual who plays a significant role in your life. By doing so, we preserve the essential benefits while recognizing the diverse forms of support and cooperation that exist in modern relationships.

This framework allows those who value the traditional, religious, or personal aspects of marriage to uphold their beliefs without government interference. By separating the religious and personal dimensions of marriage from the legal and financial, we can return to a more authentic understanding of this vital institution. Legal protections currently afforded to married couples, such as medical decision-making rights and spousal privileges, would also be encompassed within the public partnership. These include the healthcare proxy and hospital visitation rights, which ensure that partners can make critical medical decisions and visit each other in medical facilities. Spousal privileges, such as testimonial and communication privileges, protect the confidentiality and integrity of the marital relationship. Couples who undergo a marriage ceremony can choose to register for these protections, but it will not be a requirement. This dual system offers a practical solution that respects personal and religious convictions while maintaining necessary legal safeguards.

This approach has the potential to revitalize marriage and family life in America. By removing government oversight, we empower individuals to define their unions according to their values and beliefs. This shift allows couples to commit to each other and their future children without the specter of state-imposed penalties. A truly nationalist government would take further steps, ceasing foreign aid and redirecting those funds into low-interest loans designed to keep up with inflation. The current arrangements, heavily influenced by state regulations, contribute to declining marriage and birth rates. We are well below replacement levels, and a shift is necessary to incentivize both men and women to build strong, child-rearing families. The declining birth rates pose a significant threat to the nation's future, affecting everything from economic growth to social stability. By redefining the role of the state in marriage, we can create an environment that encourages and supports family formation and child-rearing.

Men, in particular, face legitimate fears about marriage and women in general due to the potential loss of access to their children and wealth in the event of a divorce or rupture. The current legal framework often disadvantages men, leading to a reluctance to enter into a relationship or marriage. These concerns must be addressed for the common good of our nation.
