Donald Trump’s defamation lawsuit against the BBC has been reassigned to a new judge, and the history of how that judge came to the bench could have disturbing First Amendment implications. Confirmed earlier this summer in a party-line vote, U.S. District Judge Jeffrey Kuntz refused to say who won the 2020 presidential election. That’s troubling enough for a case about Trump’s role in the Jan. 6th insurrection, but Kuntz lobbied for his judicial appointment while presiding over Trump’s other defamation lawsuit against the Pulitzer Prize Board as a state judge.
