Regarding your first amendment defense of Kimmel, to oversimplify slightly, the first amendment guarantees freedom of the press for those who own one. Government can't punish ABC for putting him on but Kimmel has no constitutional right at all to hold a job with them. Melania's statement does not constitute government action.
