Case closed: ICE agent cops a plea to DUI, prosecutors drop child neglect charges. And his probation was reduced to 4 months

The US Immigration and Customs Enforcement [ICE] agent who was charged with driving drunk on U.S. 1 last year — with his two boys in the backseat — is free from the Keys court system.

“Are you Haitian,” Scott Deiseroth asked a Monroe County Sheriff’s Deputy, during the stop on Aug. 13, 2025, in the Florida Keys.

Deiseroth, 43, was initially arrested on Aug. 13, 2025, by Monroe County deputies on two charges of felony child neglect and misdemeanor resisting arrest.

Monroe County State Attorney Dennis Ward’s office dropped everything but the misdemeanor DUI charge. And prosecutors only additionally charged him with resisting arrest, another misdemeanor.

This criminal case moved quickly through the Monroe county system.

On Oct. 31, 2025, Deiseroth pleaded no contest to misdemeanor DUI as charged.

Monroe County Judge Derek Lewis sentenced the ICE agent to 12 months probation, $1,663 in court costs, 50 hours of community service and random alcohol and drug tests.

The plea means he’s not admitting guilt, but instead folding to the state’s evidence. It still counts as a conviction — an adjudication of guilt in court terminology.
