Enacted on June 17, 1930, when President Herbert Hoover signed the legislation into law, it is codified at 19 U.S.C. § 1338 and authorizes the President to impose “additional duties on imports from a foreign country that discriminates against U.S. commerce (relative to other countries) through unequal duties, fees, regulations, or other practices that place U.S. commerce at a disadvantage.” - Nothing like arbitrary power, huh? And, yes, it unconstitutionally grants the Executive Branch (specifically the President) broad “discretion”:
The President must find as a fact that discrimination or a commercial burden/disadvantage exists and that the public interest will be served.
He then issues a proclamation specifying the new or additional duties.
The rate is set by the President as whatever amount he determines will offset the burden or disadvantage, capped at a maximum of 50% ad valorem (or its equivalent).

Trump’s 50% additional ad valorem tariffs on roughly $20–28 billion of Canadian goods (about 5% of U.S. imports from Canada) will be “effective immediately under Section 338 of the Tariff Act.”
