The so-called “sanctions” the United States has levied on Iran since 1979 represent a clear violation of constitutional limits. The US Constitution requires due process of law before any punitive action may be taken; no clause authorizes the executive or Congress to impose economic warfare on a sovereign nation or its people without a fair hearing in a court of law. Yet successive presidents have done exactly that.On November 14, 1979, President Carter issued Executive Order 12170, freezing Iranian assets and launching a near-total trade embargo. Additional restrictions followed in 1980 and throughout the 1980s. On March 15, 1995, President Clinton signed Executive Order 12957 targeting Iran’s oil sector; on May 6, 1995, Executive Order 12959 banned virtually all US trade and investment. Congress then enacted the Iran and Libya Sanctions Act on August 5, 1996, threatening foreign firms that invested in Iran’s energy industry.
The Comprehensive Iran Sanctions, Accountability, and Divestment Act became law on July 1, 2010, further strangling Iran’s financial and petroleum sectors. Although the 2015 nuclear agreement briefly suspended some of these pressures, President Trump on May 8, 2018, withdrew from the deal and reimposed the full suite of measures, with the broadest restrictions taking effect on November 5, 2018.
Opponents insist these repeated decrees punish an entire population without trial, judicial findings, or constitutional warrant—turning foreign policy into extrajudicial collective punishment.
