District advocates sue Klein ISD over access
Days after a former Klein ISD classroom aide was arrested on felony charges for allegedly injuring a student, additional concerns are surfacing regarding special education classroom safety and district transparency. FOX 26's Mekenna Earnhart has more.
HOUSTON - Days after a former Klein ISD classroom aide was arrested on felony charges for allegedly injuring a student, additional concerns are surfacing regarding special education classroom safety and district transparency.
What we know:
According to court filings in a pending federal lawsuit, an independent statewide advocacy organization alleges that Klein ISD has unlawfully blocked its advocates from inspecting special education classrooms for more than a year.
The lawsuit was filed by Disability Rights Texas, a federally mandated, independent agency created to protect and advocate for people with disabilities across the state. Under federal law, the organization is authorized to monitor facilities—including public schools, psychiatric hospitals, and jails—to ensure individuals with disabilities are free from abuse, neglect, and discrimination.

Allegations of blocked access, trespass warnings
What they're saying:
According to court documents filed in the U.S. District Court for the Southern District of Texas, Disability Rights Texas requested access to inspect several Klein ISD campuses following complaints from parents regarding special education programs.
Court filings allege that when organization advocates attempted to inspect special education classrooms at Benfer Elementary in September 2023, Klein ISD police officers issued them criminal trespass warnings under threat of arrest.
Shiloh Carter, a senior litigation attorney with Disability Rights Texas, said unescorted access is critical when monitoring vulnerable or nonverbal students.
"It's important for the persons with disabilities to feel like we are independent and that they can speak to us in a confidential manner," Carter said. "And so, if we have the principal or a director or someone there, that kind of chills the effect of students who may have concerns or parents who may have concerns being able to speak freely with us."
District cites visitor safety, privacy protocols
The other side:
In court filings, Klein ISD denies violating federal law. The district contends that its local visitor policies require administrative approval and supervision to protect student privacy and maintain campus security.
In an official statement provided to FOX 26, Klein ISD stated:
"Because this matter is currently in litigation, Klein ISD is limited in what we can share regarding the specific allegations or claims in the lawsuit. The district remains committed to complying with all applicable legal requirements while also enforcing the safety and security procedures required of anyone accessing our schools. Klein ISD has worked with Disability Rights Texas (DRTx) to facilitate appropriate campus access in the past and will continue to do so. The safety, privacy, and well-being of our students remain our highest priorities."
Awaiting Judicial Ruling
What's next:
A federal judge previously denied Klein ISD’s motion to dismiss the lawsuit, allowing the case to proceed. Both sides have since filed motions for summary judgment, meaning both the school district and the disability watchdog are asking the federal judge to decide the case in their favor or dismiss it without proceeding to a full trial.
