A startup just sued the US government over Fable 5 shutdown

On June 12, the Commerce Department told Anthropic to cut off Fable 5 and Mythos 5 for every foreign national on earth. Anthropic could not check nationality in real time, so it did the only thing it could. It shut both models off for everyone, all at once, globally, that same afternoon.

The UK’s AI Security Institute lost access. Allied governments lost access. Hundreds of millions of paying customers lost access. And a San Jose legal tech company called Legion LegalTech, whose Canadian developers were working from Canada, lost the AI infrastructure their entire platform runs on.

So this week they sued the federal government in Washington DC.

The complaint does not mince words. “The harm to Legion is immediate, irreparable, and existential.” They are asking the court to vacate the directive entirely and freeze enforcement while the case moves forward.

Now here is the part that should make you stop.

The jailbreak that triggered all of this, the security incident serious enough that Washington pulled the most capable AI in the world from global circulation in a single afternoon, was someone asking Fable 5 to read a codebase and fix its bugs. That is it. Anthropic says the vulnerabilities it surfaced were minor and already publicly known.

This is also the first time in history that export controls have been used to pull a commercial AI software product off the market. Not hardware. Not chips. Software. The precedent being set here goes well beyond Anthropic or Legion or any single jailbreak claim.

Anthropic is already fighting two separate lawsuits against the US over the Pentagon branding it a national security supply chain risk. Now there is a third case, filed by one of its own customers, pointing in the same direction.

The models are still offline. Polymarket traders are pricing a 59.5% chance they come back by June 30. The clock Legion called existential is still running. And nobody in Washington has explained in public what the actual threat was.
