Yesterday’s post wrestled with one of the many ambiguities in the California Financing Law’s definition of “finance lender” which defines the term as including “any person who is engaged in the business of making consumer loans or making commercial loans”.1 Putting aside for today the meaning of “includes”, what constitutes “making” a loan?
