The Emergency Early Release (EER) Scheme

The Catalyst: In May 2024, the Scottish prison population reached a critical high of over 8,300 inmates. To prevent a “systemic collapse,” the Scottish Government invoked emergency legislation under the Emergency Early Release (Scotland) Act 2024.

The Mechanism: The scheme allows for the release of prisoners serving short-term sentences (less than 4 years) who have 180 days or less remaining.

The “Dangerous” Element: While sex offenders and domestic abusers are officially excluded, the scheme includes those convicted of Class A drug supply, like Jay Conway.

Police Scotland’s Stance: Senior officers and the Scottish Police Federation have raised serious alarms. They argue this is a “policing burden shift,” where the risk is moved from the prison service to frontline officers who must now monitor these individuals in the community, often without increased resources.

The “Con” Perception: Critics argue that the government is essentially “outsourcing” the crisis to the public. By releasing traffickers like Conway—whose actions resulted in a teenager’s death—the system is seen to be prioritizing administrative efficiency over judicial accountability and victim closure.
