The Brooklyn Lyceum, once a vibrant stage at 227 Fourth Avenue hosting indie plays, film festivals, concerts and art markets, still fights a grave injustice: a 2018 appellate ruling that handed the Lyceum to a developer shark for 35 cents on the dollar absent even cursory review. Appellate judges ignored a timely motion by claiming 19 > 26 in a factual blunder, a lie, found Plaintiff timely moved by Plaintiff citing a law the Plaintiff did not cite, a lie, while ignoring the absurdity of the inappropriate law Plaintiff did cite, and sidestepped a challenge to the court’s authority, Plaintiff’s failure to serve our attorney, all tied to a 2009 motion so flawed it begged for sanctions. This isn’t just a legal battle—it’s a fight for simple procedural due process, and, also, to save a cultural heartbeat.
