Hey friend,

Arbitrators are handing down wins left and right against blanket return-to-office mandates, ruling that agency leaders didn’t have the legal authority to break active union contracts.

So with these victories stacking up, what does this actually mean for the federal workforce right now?

  • The Legal Battle: Arbitrators have ordered multiple agencies to restore pre-mandate telework levels. However, agencies are responding with expected legal appeals, meaning formal implementation will likely take 6 to 18 months.

  • USAJOBS Reality Check: Out of thousands of “telework-eligible” listings, the vast majority refer to situational/ad-hoc telework (used for weather emergencies or office repairs) rather than routine telework (3–4 days a week from home). True 100% remote roles remain heavily constrained.

  • The Recruitment Crunch: With private-sector flexibility hovering around 25% (and over 50% in tech), rigid government RTO mandates continue to hinder agencies’ ability to attract specialized IT and data science talent.

  • Legislative Outlook: With mid-term elections approaching, the ultimate wildcard is Congress. Lawmakers hold the purse strings and could potentially block RTO enforcement through upcoming appropriations riders.

The path forward involves a bunch of appeals, the demand for flexibility means telework and remote work will expand as federal agencies fight to retain critical talent.

OPM is trying a desperate rebrand.

Even after pushing out over 300,000 federal workers and freezing hiring, a tiny four-person social media team is suddenly leaning into TikToks, Christopher Nolan memes, and “what’s on my desk” videos to convince Gen Z that government work is “cool.”

It’s a tough sell when it completely clashes with reality.

Between mass layoffs, probationary purges, and the elimination of programs like the Presidential Management Fellows (PMF), the under-30 federal workforce has dropped from 8.9% down to 7.9%.

Programs like the “Tech Force” are falling way short of their hiring goals, and rigid return-to-office mandates are killing the flexibility younger workers expect.

When you combine that mixed messaging with USAJOBS’ notoriously slow, confusing application process and a massive private-sector pay gap, it’s easy to see why OPM is panicking.

With nearly 14% of the government retirement-eligible, they’re staring down a ticking time bomb and a few try-hard desk tour videos aren’t going to fix it.

A new analysis by the Partnership for Public Service reveals a contradiction in the government’s recent workforce cuts: agencies have already backfilled roughly 20,600 of the positions lost under last year’s deferred resignation program (DRP).

While the Trump administration slashed the civil service by over 300,000 employees last year, with about 41% stemming from the DRP, researchers found that many subcomponents quietly rehired for those exact roles by June 2026.

Unsurprisingly, The OPM Director pushed back hard on the findings. In a blog post, Kupor argued that the data’s job classifications are too broad to prove direct backfilling, and countered that the report actually shows 85% of DRP departures were not replaced.

At the same time, OPM isn’t exactly hiding the fact that these new hires look different. The analysis showed that backfilled positions came in at an average of 1.4 GS grades lower than the departing workers, with FBI criminal investigators dropping an average of 3.1 grades.

Kupor defended this shift, arguing that bringing in early-career talent at junior levels is a necessary strategy and fix the government’s aging demographic problem.

Even so, watchdogs remain critical. Agencies like FEMA, the IRS, and the GSA are facing ongoing heat for purging staff without any real plan for how it would impact public services.
