“Software installed by hackers”- how the Polish Press Agency lies about the Newag scandal

I'm assuming you're familiar with the scandal at hand.

On June 11th 2024 at 11:21 the Polish Press Agency (PAP) published the following (translated from Polish to English):

The Regional Prosecutor in Cracow is conducting preparatory proceedings regarding software installed by hackers causing the locking up of the Impuls series of trains manufactured by Newag from Nowy Sącz - said press spokeswokman of the prosecutor Katarzyna Duda.

However if we read more than just the heading we'll find the actual quote (from prosecution spokeswoman Katarzyna Duda, translated from Polish to English):

This is a preparatory proceeding regarding making unauthorized changes of recorded computer data in the control system of a few dozen Impuls series vehicles, consisting of installing on their controllers software causing their lock up during normal use, and thus causing the vehicles' owners to disagvantegely dispose of their property.

This is a fantastic example of lying by distortion: the spokeswoman has said nothing anout hackers, but PAP's header implies the proceedings are strictly about some software installed by some hackers. The wording „unauthorized changes of recored computer data” comes most likely from Article 286a., § 1. of the Polish Penal Code, which is the article over which the preparatory proceedings are being conducted.

We must then issue a correction: based on both the above quote and our own knowledge, the matter of proceedings conduted by the Regional Prosecutor in Cracow regards the whole of the subject of the existence and authorship attribution of the lock mechanism, and not suspicion of about „software installed by hackers”.

We have gotten in touch with the author of the message (Szymon Bafia) in order to correct the error, but in response we've only received an opinion that since it was an unauthorized change then it must be the doing of hackers, and that this also corresponds with what Newag's chairman says. Our request to change the header to properly mark it as the author's or Newag's chairperson's opinion has been ignored. We are currently in the process of escalating the matter to the editorial office of PAP.
